Types of power of attorney and required documentation

  • Special power of attorney for lawsuits: it is conferred to an attorney, whose personal data and office address must be indicated. You must also indicate the litigation's reference data (relevant Court and type of litigation).

  • Special power of attorney for real estate purchase or sale transactions: in addition to personal data and Italian social insurance number (codice fiscale), you must indicate the real estate's exact cadastral data or at least its description and address.

  • Special power of attorney for car sales: you need to specify the vehicle data (brand, license plate and chassis number), by exhibiting the logbook/car registration documents if possible.

  • Special power of attorney to cash: for cheques or money orders you need the denomination of the paying office, number and issuing date; for interest-bearing postal bonds you need the series, number, amount, issuing Postal Office and issuing date; for withdrawals of money from a current account you need the denomination of the banking-house or of the Postal Office, the account or passbook number and the amount of the withdrawal.

  • Special power of attorney to administer the properties acquired by succession or through acceptance/renunciation of inheritance: you must indicate the decedent's personal data (first name, last name, birthplace and date of birth, place and date of death). In the case of a power of attorney to renounce an inheritance the presence of two witnesses is required: the witnesses must be Italian or Italian-speaking and they cannot be relatives of the interested parties.

  • Special power of attorney for a donation: two Italian or Italian-speaking witnesses, not relatives of the interested parties must be present and you need to produce a detailed description of the donated property (with cadastral data in the case of real estate) and the beneficiary's full personal data.

  • Special power of attorney to accept a donation: two Italian or Italian-speaking witnesses, not relatives of the interested parties must be present and you need to produce a detailed description of the donated property (with cadastral data in the case of real estate) and the donor's personal data and residence.

  • Termination of a power of attorney: you must indicate all the data related to the power of attorney that needs to be terminated (date, file number in the notarial register, personal data and address of the prosecuting attorney). The person concerned must subsequently forward the termination to the attorney and to the Italian notary public who registered the document, at his own expense and responsibility.
